Legal Experts - Jury Service

AHHHHH jury duty how we complain about it. But bet you would like 12 guys/gals vs just a judge deciding the rest of your life...
That said I had it 5 times in 3 years in Gwinnett county. I asked the last time just how many people live in Gwinnett county and had they gone through that many people for jury duty? Never got a answer just the computer picks your name. Later that year was a news item about jury pool rigging.
2 years ago I had it again was picked to go in then the lawyers kicked me off back to the ft part to wait The lady said everyone not picked can leave...cut a rug out the door! I was home like 15 minutes phone rang..."This is Judge ...... is this Charles?" yup that is me sir"Would you like the sheriff to pick you up and bring you back here?" No sir
"You are ordered back here" Yes sir "Be quick I am waiting on you!" Yes sir....Cut a faster rug back sheriff was waiting for me asscorted me in to room where everyone was indeed waiting for me....Judge said a few choice words...I sat down lawyers released me from that case too.....
But they take jury duty serious in Gwinnett county:)

since when? serious question.. can you prove that also? Im not attacking you, Im just working though some of these issues from many different angles these days trying to get a better comprehension of some of these "incomprehensible" legalities. most are void for vagueness anyway.

Do some research. I believe it has been since 1931 when Arkansas became the last state to revoke alien suffrage.

Robin, did you provide evidence beyond the checkbox documenting your status? I would think a xerox of your passport would suffice.

safe to say that you do not agree then. what is a legal fiction? (What is real? -Morpheus)

FWIW I dont do "google"

Serving on jury duty sucks.

They should call the unemployed, retired and welfare peeps, what else they have to do all day? and shit.

Yes,but that takes common sense.we cannot have that in modern America.....I've always felt the same, call the unemployed

A couple of weeks ago I got a letter telling me I had to report for jury service. I sent it back asking to be excused due to the fact that I'm not a US citizen. Yesterday I got another letter saying my request had been denied and I have to be at the courthouse at 9:00 on Monday.

Everything I've read says that non-citizens are not eligible for jury service, what would happen if I don't turn up? I will miss work if I go and will not be paid for the time.

Also do they need to inform you of being called at least 30 days before the date you're due to go?

Poor ALCKOHOL all over your self and attend, you will be excluded!!!!!!!!!

Thay do not want drunks involved

Did you send them a copy of your green card? If you did there's no way they should have sent you a "show up or else" letter. I imagine they get the "I'm not a citizen" excuse all the time.

That's probably the problem, I didn't and for some reason I have it in my mind that it is illegal for me to make a copy of my green card, I might be wrong on that though. I doubt they get the excuse much in this area, there's only around 50-60,000 people in the county and very, very few foreigners.

they operate on presumptions, and if their presumptions are not rebutted will stand as fact. this includes "remaining silent" or: qui tacet consentire videtur, another "legal maxum"

edit: make that "Maxum of Law" BIG difference! my bad.

this is a test. lol

a talking head.. HA! (the best of) but if there were no "points of view" then how could there be any "facts" its all perspectives.

and you should try this: define "person" with a legal dictionary. you may find it interesting. again.. "What is real?"

is that your assumption?

Yeah you should see the crackheads that show up in Baltimore city, and still get to do it.

And yet, you still think this is how it should be done?

I don't get it. If I were in the unfortunate position to have my fate in the hands of 12 of my 'peers' I would want them to be intelligent, educated, ably employed productive members of society. (No offense intended to those unfortunetely laid off or out of work right now due to the economy, etc).

Jury duty sucks. We all know that. No matter, it's an important obligation and a cornerstone of our judicial system. I never try to get out of it, but never get picked.

Jury Duty is awesome!

Not getting picked sucks, only two days off work with pay for that, but catch a trial and it's two weeks paid time. The trials I've served on never lasted more than 3 days, which means that even if it wasn't a great experience, it would be worth it for the remaining 7 days vacation.

Some of you would make great jurors, what with the need for very explicit explanations and proof. At the very least, you'd find it very entertaining to torture the remaining jurors who I've found just want to move on with their own lives.

We did make a mistake as a jury for one of the cases though, the Asst. DA was trying to be pretty slick with what we were allowed to know, and weren't, while the defense attorney let her hang herself. We ended up letting a third time felon (very violent assault) off on misdemeanor assault because we stopped believing the Asst DA when she started cutting portions of the 911 calls, and her witnesses had glaring contradictions in their stories.

Turns out he was a guy who had a habit of cutting people up with very large knives off, the Asst DA was pissed when she found out what happened to her case. On the plus side, the guy was deported to Jamaica regardless, and there was one less gang member/drug dealer in the area.

The defense never let the guy speak, never said he didn't do it, and called no witnesses. She just let the Asst DA call kids who freaked out as soon as the saw the bad guy was in the room.

Robin -

Not sure your employer can dock your pay for having to attend jury duty. I don't know, but it seems pretty suspect. I'll check and advise you further. In the meantime, get stuff in writing (or at least have your own self-serving confirmations of their requirements) from the bozo's who insist you appear despite your best efforts.

More to follow.

Cheers,

Dave

First time I got called in it was a murder one trial. I knew the judge, the investigating cops and the lawyers and thought I was out of there in 20 minutes. Shit, the judge addressed me by my childhood nickname. :D When the prosecution said "accepted" I thought "yeah, that was expected." When the defense said "acceptable" I about shat my pretty little preppy pants. :D

The next time I got called, I was was tossed out in about 5 minutes. :D

Shit, I think I've been called 4 or 5 times.
