Is it stealing in the following cases? 1. Someone takes your money to paint your house and completes a small portion and then disappears? 2. You mistakenly ship parts to the wrong people and the one who received the benefit refuses to return your calls and emails? 3. You loan several parts to someone and they refuse to acknowledge the need to return them even though you have a signed itemized list of the parts. These are all hypothetical questions mind you.:tut:

In the criminal law dept., theft (also known as stealing) is the illegal taking of another person's property without that person's freely-given consent.
That first item really pisses me off. I never pay full price for home services until they are complete. I had the roofing guy that did my garage leave the job to go finish a church job with about a 10' x 10' section of my room still not done. I asked the contractor(a friend and coworker) that hired him if the roofer had been paid in full. He said yes so I told him that no more money was being paid by me until my roof was done and they could decide who would finish it or take the asswhoopin. It was done that afternoon.
But in the end, if you have recieved something that you didn't pay for and then don't return it, then you have stolen it. Theft by recieving. It happens all the time in vending machines. Same principle.
i say yes in all 3 cases. Even in case #2 is is termed "unjust enrichment".. example: fence company puts up a fence at 512 main street but was supposed to be at 521 main st. 512 main has to pay or allow the co. to pull the fence down. they dont get it for free just "cause".. The 3rd case sounds all to familiar at the track.. people loaning shit out to perfect strangers only to not get parts/tools back.
Hypothetically, of course, I believe the "painter" was a "friend",with a family, that was out of work and down on his luck due to a racing injury . Michelle
I loaned a spare back protector to a guy at Jennings and I never saw him again. That was the last time I loaned anything to anyone I didnt know.
